Using PhotoMemorial

These Terms govern your use of the PhotoMemorial website and memorial-photo service. “PhotoMemorial,” “we,” and “our” refer to this service. By using it, you agree to these Terms and the Privacy Policy. If you do not agree, do not upload photos or purchase credits.

What the service provides

PhotoMemorial AI combines two submitted photos into a synthetic memorial photograph and may apply AI refinement to a completed HD image. It is not grief counseling, identity verification, a funeral service, a historical archive, or an emergency service. It does not publish or share photos automatically.

Eligibility and photo rights

You must be at least 18, or the age of legal majority where you live, to purchase credits. You confirm that you own or have lawful permission to use every uploaded photo and to create the requested synthetic image. You must consider the dignity, privacy, publicity, cultural, and family interests of every depicted person, including a deceased person.

You may not use PhotoMemorial AI to impersonate, deceive, defame, harass, exploit, create sexual or violent abuse, evade consent, commit fraud, violate law, or infringe intellectual-property, privacy, publicity, or other rights.

AI limitations

AI output may change identity, age cues, expression, hands, anatomy, clothing, jewelry, background, lighting, or historical details. Results are not guaranteed to be accurate, photorealistic, suitable for printing, or emotionally appropriate. Review every result before downloading, printing, or sharing it. Do not present a generated image as an unedited historical record.

Accounts and private history

Google sign-in can claim an eligible anonymous result and associate it with your account. Signing in does not itself start generation or consume a credit. You are responsible for your Google account security and activity under your PhotoMemorial AI account. You can delete individual tasks or close the account; payment records may be retained separately as described in the Privacy Policy.

Credits, payments, and downloads

• Credit packs are one-time purchases, not subscriptions.
• One credit pays for one watermark-free HD generation or one AI refinement.
• Credits do not expire.
• A credit is reserved before paid generation, confirmed when generation succeeds, and returned automatically when the provider fails.
• Re-downloading an existing successful image does not consume another credit.
• Stripe processes checkout and card information. Credits are granted only after PhotoMemorial AI verifies the paid Checkout Session with Stripe; signed webhooks remain the primary reconciliation path.

The current prices are shown on the Pricing page. Taxes, currency conversion, or issuer fees may apply depending on location.

Refunds

The Refund Policy is part of these Terms. Unless mandatory law provides more, a request made within 14 days of purchase is eligible for a proportional refund of unused credits. Credits already spent on successful generation are not refundable. Provider failures return the reserved credit and do not by themselves create a duplicate cash refund.

Availability and changes

Image generation depends on third-party services and may fail, be delayed, or become unavailable. PhotoMemorial AI may suspend unsafe, abusive, unlawful, or technically harmful use. Material product, price, or Terms changes will be disclosed as required. Purchased credits will not be silently removed merely because the product changes.

Intellectual property

You retain any rights you lawfully hold in uploaded photos. You grant the operator and necessary service providers a limited license to host, copy, transmit, transform, and display the material only to provide, secure, and support the requested service. Rights in an AI-generated output may vary by jurisdiction; PhotoMemorial AI does not guarantee exclusive ownership or copyright eligibility.

PhotoMemorial AI's software, interface, brand, and original site content remain protected by applicable law and may not be copied or exploited beyond ordinary service use.

Disclaimers and liability

The service is provided on an “as available” basis to the extent permitted by law. Nothing in these Terms excludes consumer rights or liability that cannot lawfully be excluded. Subject to those rights, the operator is not responsible for indirect or consequential loss, emotional reactions to an output, misuse by a user, or third-party outages outside reasonable control.

Your rights and contact

Nothing in these Terms removes mandatory consumer protections or other rights available to you under applicable law. If you have a concern about the service or these Terms, contact support@photomemorial.ai. Contacting support does not prevent you from using any complaint or legal remedy available to you.
